ANR Pipeline and a shipper have entered into service agreements for the following services:

As provided by Part 6.2.10(j), Sale of Service, in the General Terms and Conditions of ANR's FERC Gas Tariff, ANR may sell, on a pre-arranged basis, available firm capacity one year or more in advance of the date that the service is to commence, provided the capacity is made available through the open season process. As such, this pre-arranged open season commences at 3:00 PM CST on Wednesday, December 21, 2016 and will end at 3:00 PM CST on Thursday, January 5, 2017. Winning bidders will be notified no later than 3:00 PM CST on Friday, January 6, 2017.
Interested shippers must bid on the full suite of services above for a minimum 10-year term. If a shipper submits an acceptable bid with a higher incremental economic value, the pre-arranged shipper will have a one-time right to match the higher bid within five (5) business days of notification in order to retain the capacity. If the pre-arranged shipper elects not to match a higher competing bid, the capacity will be awarded to the creditworthy bidder bidding the greatest NPV.
Pursuant to ANR's tariff, all requests will be treated equally under this open season. ANR reserves the right to reject any bid that does not specify the paths, services, or terms posted above. All bids submitted during the open season may be withdrawn and/or replaced with an equal or higher Net Present Value (NPV) bid during the open season period. Bids cannot be replaced with lower NPV bids. Parties interested in this capacity may specify an acceptable minimum prorated MDQ. ANR reserves the right to reject any bids where path, service, or points deviate from those listed above. ANR reserves the right to reject any bid that has a negative NPV. ANR reserves the right to reject negotiated rate bids. ANR reserves the right to reject bids with deviations in monthly MDQs. ANR reserves the right to reject contingent and incomplete bids. ANR has the right but not the obligation to clarify and finalize incomplete bids. Upon completion of this open season, all remaining bids will be considered binding until a successful bid(s) has been awarded.
All complete bids received during the open season will be evaluated and compared with the Initial Shipper's request for service on a Net Present Value (NPV) basis using the factors below.
NPV = En [R*(1 / (1+i)**n)]
En = Summation of months 1 through n (Sigma)
n = term in months
R = Incremental monthly revenue
i = Monthly Discount Factor (current FERC quarterly rate) This rate can be found at http://www.ferc.gov/legal/acct-matts/interest-rates.asp
If more than one bid has the same NPV, then the capacity shall be allocated pro rata to shippers with matching NPV bids. All qualifying bids will be subject to the pre-arranged shipper matching and retaining this capacity. If the pre-arranged shipper does not choose to match the qualifying bid(s), capacity will be awarded to the qualifying shipper(s).
