RE: AVAILABLE FIRM WISCONSIN CAPACITY (Open Season #202)


ANR Pipeline Company ("ANR") is initiating an open season for the following firm capacity:


Option #1: Crystal Falls to Kaukauna/ML7/ML3 CAPACITY

ANR has 80,000 Dth/d of firm primary transportation from Crystal Falls (#11661) to Kaukauna (#387791) for an annual term beginning November 1, 2016 and ending October 31, 2017.

Shipper has the ability to choose a different primary delivery point in ML7 or ML3 north of the Rex Shelbyville point (#742252) for the summer portion of the contract.

Due to the complex nature of ANR's system within the state of Wisconsin this volume is subject to change based upon the combination of receipt and delivery point bids received.



Option #2: Marshfield to ML7 or ML3 CAPACITY

ANR is able to offer a receipt at Marshfield (#28873) to deliver 80,000 Dth/d of firm primary capacity to points in ML3 north of the Rex Shelbyville point (#742252) and points in ML7 excluding Wisconsin.

Shipper has the ability to choose a different primary delivery point in ML7 or ML3 north of the Rex Shelbyville point (#742252) for the summer portion of the contract.


Additional information

Option #1 and Option #2 are mutually exclusive. Should ANR award capacity under one option, it will reduce the total capacity available under the other. In both options, shippers can bid more than one year, but only in annual increments.

Available capacity volumes are contingent upon mainline, meter and lateral capacity. ANR has the right to award capacity to a mutually agreed-upon alternate receipt or delivery point if capacity is unavailable at the meter(s) specified in the bid. ANR has the right but not the obligation to consider bids with receipt and delivery points outside the areas designated above. Only 44,000 Dth is available for multiple year bids or bids with ROFR in ML3.







Minimum Acceptable Bids
The minimum acceptable bid term is November 1, 2016 - October 31, 2017.

The minimum acceptable reservation rate for this offer is undisclosed. ANR will consider discounts, but reserves the right to reject any bids less than the maximum tariff rate. Bidding the maximum tariff rate for an annual term will qualify the winning bidder to receive ROFR on the contracted capacity.

Secondary Receipt/Delivery Points:
If a bid is awarded at a discount, all secondary receipt and delivery points will be available at the same rate on a secondary basis at the bid rate for the zones traversed on the contracted primary path.

ANR will be holding this open season in accordance with Part 6.2.10 (h) of the General Terms and Conditions of its FERC Gas Tariff, commencing at 4:30 p.m. CCT Thursday, October 20, 2016 and ending at 10:30 a.m. CCT Monday, October 24, 2016. Winning bidders will be notified no later than 4:00 pm Monday, October 24, 2016. Pursuant to ANR's tariff, all requests for service for the capacity available above will be treated under this open season. All bids submitted during the open season may be withdrawn and/or replaced with an equal or higher rate bid during the open season period. Bids cannot be replaced with lower rate bids.

Other Terms and Conditions
This open season is for the capacity available for the receipt and delivery point combination/path(s) specified above. As such, ANR reserves the right to reject any bid that does not specify the path(s) posted above. ANR reserves the right to reject any non-uniform path for the duration of the contract at less than tariff rates. ANR reserves the right to reject bids without a term of November 1, 2016 through October 31, 2017. ANR reserves the right to reject bids with deviations in monthly, seasonal, or annual MDQ's. ANR reserves the right to reject discounted bids. ANR reserves the right to reject bids for rate schedules other than FTS-1. ANR reserves the right to reject negotiated rate bids. ANR reserves the right to reject any request that is incomplete, contains modifications to the terms bid form(s), or conflicts with ANR's FERC Gas Tariff. Available capacity volumes are contingent upon mainline, meter and lateral capacity. ANR has the right to award capacity to a mutually agreed-upon alternate receipt or delivery point if capacity is unavailable at the meter(s) specified in the bid. This open season is subject to ANR's FERC Gas Tariff and to all applicable laws, orders, rules, and regulations of authorities having jurisdiction.
















BID EVALUATION

All final bids received during the open season will be evaluated based on highest NPV. ANR reserves the right to accept the combination of bids that creates the highest overall NPV. In the event of a tie, capacity will be awarded pro rata. Bidders may specify an acceptable minimum pro-rated MDQ.

Upon completion of this open season, all remaining bids will be considered binding until a successful bid(s) has been awarded.

Awards shall be made to the bids with the highest NPV. If more than one bid has the same NPV and requests for service exceed available capacity offered in Open Season #202, then the capacity shall be awarded pro rata to shippers with matching NPV bids. In the event of a tie, parties interested in this capacity may specify an acceptable minimum prorated MDQ.
